Limitation of Liability

 

 

1. General Limitation

To the fullest extent permitted by applicable law, the liability of handelsondernemingdomburg shall be limited to the amount paid by the Customer for the specific product giving rise to the claim.

 

2. Exclusion of Indirect Damages

Handelsondernemingdomburg shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of revenue, loss of business, vehicle downtime, installation or removal costs, or any other economic loss arising out of or in connection with the use of the products supplied.

 

3. Installation and Use

All products must be installed by a qualified and competent professional. Handelsondernemingdomburg shall not be liable for any damage resulting from improper installation, misuse, modification, or use of products in a manner inconsistent with their intended purpose.

 

4. Product Compatibility

It is the Customer’s responsibility to verify compatibility of parts with their specific vehicle, including but not limited to model, year, engine type, and VIN number.  Handelsondernemingdomburg shall not be liable for damages arising from incorrect part selection.

 

5. No Liability for Vehicle Damage

Handelsondernemingdomburg shall not be liable for any damage to vehicles, engines, components, or other property resulting from the installation or use of supplied parts, except where such liability cannot be excluded under mandatory law.

 

6. Mandatory Legal Rights

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud, willful misconduct, or any liability that cannot be excluded under applicable law.
